NOTICE LETTERS OF DATA INTEGRITY VIOLATION:
CRMLS will issue Notice of Violation Letters to the offending Agent/Broker. The purpose of the letter is to serve notice of the violation, and, most importantly, educate the member on the nature of the violation and promote future compliance.
In the event a member reports a listing complaint that is beyond the scope of the four areas of the CRMLS Data Integrity Policy, CRMLS will refer the complaint to the listing agent/broker’s local Association by the use of the “Referral of Listing Complaint Letter”.

Notice of Data Integrity Violation – Virtual Tour Field

Virtual Tour Field: The Virtual Tour Field should only contain a valid Virtual Tour Link that displays a non-personalized virtual tour for the use by another cooperating real estate professional using the MLS System to promote the subject property to their clients.
Your listing contained the following inappropriate information in the Virtual Tour Field causing a false Virtual Tour Icon (the motion camera icon) to appear in the CRMLS Matrix System:
• Regular text not related to a virtual tour link. Please do not use the virtual tour field as a continuation of the property description. Text typed in this field will not appear in the listing display. However, it causes a Virtual Tour Icon to appear leading the viewer to a broken link on the Internet.
• Offensive or obscene images
• A link directing the viewer to a website. Your Virtual Tour Field contained a link to your Personal Website or your Broker’s Website.
• A link to a Virtual Tour that contains Listing Agent/Broker Advertisement. Since the MLS is a System for cooperating real estate professionals to provide information to their customers, any advertisement of the Listing Agent/Broker is inappropriate.
• A link directing the viewer to a website advertising other services. The Virtual Tour link shall not be used as an advertising vehicle to any other services.
CRMLS Action: CRMLS has removed the inappropriate information from our database. The Notice of Violation is hereby given to the responsible agent/broker and a copy of this notification is also being sent to your board/association.

Notice of Data Integrity Violation – APN

This letter is to inform you that your listing referenced above has violated the Data Integrity Policy of California Regional Multiple Listing Service, Inc. regarding the Virtual Tour Field.
Assessor’s Parcel Number: The Assessor’s Parcel Number is very important part of the listing information. Not only is it needed to link the listing to the tax database to locate tax assessment and sales information, it is also used to link listings within the Property Archive Report database. Every listing must have the correct APN as assigned by the County Assessor’ Office. The CRMLS Matrix System contains assessor’s tax data files for four counties – Los Angeles, Orange, Riverside and San Bernardino – from which the APN can be derived. You can even auto-populate the APN, and associated fields, directly from these files.
Your listing contained one or more of the following violations:
• The APN number belongs to another property.
• The APN number you entered is incomplete.
• A fake APN was entered.
CRMLS Action: CRMLS has changed the APN to reflect the correct APN number for the subject property address from tax records on our System. The Notice of Violation is hereby given to the responsible agent/broker and a copy of this notification is also being sent to your board/association.

Notice of Data Integrity Violation – Conditional Offer of Compensation

Listing Entry: Listings that contain any languages making reference to a Conditional Offer of Compensation (other than those types of Listings covered by section 7.15 of the California Model Rules regarding Estate Sale, Probate, Bankruptcy or Lender Approved Listings) is in violation of section 7.12 of the California Model MLS (Multiple Listing Service) Rules.
Example of violation languages are:
“If I show the listing to your buyer, the commission will be #####”;
“If my office shows it first, the commission will be #####”.
Your listing contained one or more of the following violations:
• Your listing made references to Conditional Offer of Compensation in the Property Descriptions field.
• Your listing made references to Conditional Offer of Compensation in the Office Comments field.
• Your listing made references to Conditional Offer of Compensation in the Additional Financial field.
CRMLS Action: CRMLS has removed all references to Conditional Offer of Compensation other than the unilateral offer of compensation entered in the CSO field. The Notice of Violation is hereby given to the responsible agent/broker and a copy of this notification is also being sent to your board/association.
The purpose of the MLS is for Listing Agent/Broker to make a unilateral offer of compensation to cooperating real estate professionals to promote the listed property to their clients, at the commission rate disclosed in the SO Comp field. Disputes involving performance of duties and/or procuring causes must be brought as a separate action with the Association. Please take a moment to review Section 7.12 of the California Model MLS Rules to gain a basic understanding regarding the Conditional Offer of Compensation violation.

Members should not try to gain additional exposure by adding the listing into Residential SFR. It is misleading, skews the statistics and makes CMAs cumbersome and often incorrect.

• Change your Listing from Residential SFR to Mobile Home.
